These terms are an agreement between you and Swell & Stack Co. LLC dba Swell & Stack Co., a Wyoming limited liability company ("we", "us"), the publisher of the Punchd app for iPhone and iPad. By downloading or using Punchd you agree to them. Apple's Standard End User License Agreement also applies to your copy of the app; where the two conflict, Apple's EULA governs your licence to the app itself.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Punchd on Apple devices you own or control, for your own record keeping. You may not resell, sublicense, rent or redistribute the app, reverse engineer or decompile it except to the extent the law says you may, or use it to misrepresent hours you did not work. This licence ends if you break these terms.
Punchd records the hours you enter, tracks breaks and pay periods, and estimates what those hours are worth using the overtime rules you select. It is a personal record-keeping tool. It is not a payroll system, not a timekeeping system of record for an employer, and not a substitute for your employer's own records.
Estimates only. Not legal or tax advice. Every hours figure, pay figure and paycheck comparison Punchd produces is an estimate based on what you entered and the rule set you chose. Overtime law varies by state, by industry, by union agreement and by how your employer classifies you, and it changes over time. Punchd's built-in rules cover federal (FLSA) overtime plus simplified versions of the California, Alaska, Nevada and Colorado daily rules; every other state falls back to the federal rule. Punchd does not model tax, withholding, deductions, tips, shift differentials, piece rates or bonuses, so its gross figure will not match the net figure on a pay stub. Do not rely on Punchd as the basis for a wage claim, a tax filing or a dispute with an employer without checking with a qualified professional.
Punchd is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that any pay, overtime or paycheck-check figure Punchd produces is accurate, complete, current or compliant with the wage and hour law that applies to you, and we do not warrant that the app will be uninterrupted or error free.
Punchd stores your records only on your device. There is no server-side copy, no account and no sync, so we cannot recover anything for you. If you delete the app, reset your device or lose it, those records are gone. Export a timesheet PDF or CSV whenever you need a copy you can keep.
Punchd Pro unlocks pay calculations, exports, the paycheck check and additional jobs. It is an auto-renewing subscription sold by Apple at $4.99 per month or $29.99 per year, each starting with a 1-week free trial. Payment is charged to your Apple Account when the free trial ends, unless you cancel before then. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours of the end of that period. Manage or cancel your subscription in iOS Settings under your Apple Account — Punchd cannot cancel it for you, and deleting the app does not cancel it. Cancelling stops future renewals; it does not refund the current period. Any unused portion of a free trial is forfeited when you buy a subscription. Refunds are handled by Apple under Apple's terms. Prices are in US dollars and may differ in other storefronts; if we change the price, Apple will ask you to agree before the next renewal.
To the maximum extent permitted by law, Swell & Stack Co. LLC dba Swell & Stack Co. is not liable for lost or underpaid wages, lost records, lost profits, or any indirect, incidental, special or consequential loss arising from your use of Punchd or from any figure it produced. Our total liability for any claim is limited to the amount you paid us for Punchd in the twelve months before the claim.
We may update these terms; the current version always lives on this page with its date. Continuing to use Punchd after a change means you accept the updated terms.
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Nothing here takes away a consumer protection you have under the law of the place you live.
